BibeliB Paris - Conditions of sale

PREAMBLE

These Conditions of Sale are concluded between, on the one hand, the company  BibeliB SAS, a simplified joint stock company with capital of 5572.00 euros, registered with the Registre du Commerce et des Sociétés de Paris under the unique identification number 538 515 487,  whose registered office is at 16 Boulevard de Sebastopol 75004 PARIS, hereinafter referred « BibeliB », and, on the other hand, people connecting, using or wishing to purchase via the website BibeliB http://www.bibelib.com, hereinafter called « The Client ». 
If you are a professional, You are invited to contact  BibeliB, by email at the electronic adress  [email protected] or by mail at the following adress : BibeliB - 16, boulevard de Sebastopol 75004 PARIS. If necessary, you could not benefit from the provisions of these Terms and Conditions which are intended only to consumers. In addition and in case of high traffic on such an offer identified and proposed, BibeliB would reserve the right to refuse your order. 
In any event, the parties agree that their relations will be exclusively governed by these Terms and Conditions, excluding any promotional offers previously proposed by BibeliB and available on its website. 
If a condition is found to be lacking, it would then be adjusted according to the current procedures for distance sales on the French national territory.
However, it is clear that BibeliB reserves the right to modify at any time these Terms and Conditions without prior notification of the Customer. It recommends to it, therefore, to refer regularly to the latest version of the General Conditions of Sales of the Company as contained and posted on its website. To this end, the Client has the option to reproduce these Conditions of Sale.
This being exposed and having considered all of these Conditions of Sales, the Client agrees to them by ticking on a voluntary basis, the box labeled « I accept the Terms and Conditions of Sales » (it is specified; that insofar as the customer order products online, its agreement on the content of the General Conditions of Sales doesn't requires handwritten signature)). 
Otherwise, the Customer is asked to leave the website of  BibeliB and definitively abandon the online ordering process..  

SECTION 1 - SUBJECT OF THESE TERMS OF SALE
The Customer entrusts  BibeliB the manufacture of one or more protective covers luggage, cabin or bunker,like selected colors and supporting or not printing a personalized message duly and regularly transmitted in advance to BibeliB electronically. 
The covers that BibeliB provides clients comply with the legislation and with safety standards applicable in France and Europe.  
The   BibeliB  covers supporting a personalized message printing are created following digital sublimation process and, from files accepted by BibeliB in the below described conditions regularly and previously provided by the Customer in high definition PDF, TIFF, PSD or AI.  

SECTION 2 - RESPONSIBILITIES
The  BibeliB  website is free for the Customer so that it determines the essential qualities of the product ordered by him. 
That said, in any case BibeliB not be held responsible for technical errors and / or hardware, data loss resulting from the use of its website by the Customer. 
BibeliB has, during all stages of the technical process leading to the realization as well as the actual edition of the product ordered, a mere obligation of means. 
The responsibility of BibeliB can not therefore be held liable for any inconvenience or direct or indirect damage inherent in the use of the Internet, including a break of service, external intrusion or presence of computer viruses or any other incident of force majeure and in accordance with jurisprudence.
In addition, the Customer undertakes not to use the services provided by BibeliB for : carry or transmit via the product as ordered or illegal content, illegal, harmful, threatening, abusive, vulgar, obscene, hateful, or otherwise objectionable ; carry or transmit content that could constitute, without the following being limiting, incitement to commit crimes and offenses of defamation and insult, false news, to undermine the authority of justice, information relating to the privacy of another's privacy, act endangering minors particularly by the spread of violent or pornographic messages to or likely to cause serious harm to human dignity, a counterfeit mark or identifier. 
In all cases, the Customer shall be solely responsible for the content of individual messages sent to  BibeliB for printing. Thus, and in any case, the liability of BibeliB will be sought because of the impression that content individualized message and its dissemination, by transporting the bag, by the Client. 
However, it is clear that BibeliB reserves the right to refuse to perform the actual implementation of the order, if it were found that the individualized messages intended for printing by the customer on baggage protection cover was contrary to morals, good customs and / or laws and regulations applicable in France.  
The Customer undertakes, furthermore, not to interfere or disrupt the  BibeliB Internet network , not to record or transmit data and files that contain viruses or programs to overwrite data in memory or other contaminating function and more generally, does not violate the policies or regulations of networks connected to the Internet. 

SECTION 3 - ORDER
Customer acknowledges explicitly have the powers and authorizations to enter into this contract. It is forbidden to use false information or use information from third parties. 
The order placed by the Customer on the  BibeliB website is a contractual relationship. The Customer must verify the completeness and compliance information supplied by him when placing the order.  
BibeliB not be held liable for any data entry errors and / or consequences that would result.  
The placing of the order is confirmed by BibeliB by E-mail or any other means at his convenience. 
This confirmation informs the customer that the order has been recorded by BibeliB but this confirmation does not mean the acceptance thereof, which may be refused for the reasons above exposed in Section 2. 
Following acceptance of the order, BibeliB is responsible for final and immediate execution of the order but, subject to availability. For products not stocked, the BibeliB offers remain valid subject to availability from suppliers (Note that information directly from said suppliers could then contain exceptional errors or modifications without  BibeliB can be held responsible).
In the event of unavailability of products not stored after placing the order, the Customer will be notified by email upon receipt of information by suppliers. Unless it wants an alternative, the unavailable order will be canceled and the Customer will be refunded if your bank account has been debited. 
Finally, it is clarified that the actual production and delivery of luggage ordered protective covers will be effectively followed after payment of the amount corresponding to the Customer's order. 

SECTION 4 - RATES
The amount of the order will be determined in accordance with the prices charged by BibeliB into force on the date of order. 
The prices mentioned in the order confirmation is the final price, expressed all taxes and VAT. These prices also include transportation costs that are borne by the Customer (unless the customer chooses the shipping option: Relay package), being observed that a surcharge may be practiced by BibeliB in case of delivery outside the french territory. 
BibeliB may unintentionally receive incorrect rates. Only the amounts mentioned in the confirmation of the Customer's order are authentic, the amounts given of home Internet pages are, in turn, provided for information purposes only..  

SECTION 5 - PAYMENT
The Client may pay BibeliB by credit card (American Express, Mastercard, Visa).
The credit card payment is made with the means of payment Secured of  la banque Caisse d'Epargne (SYSTEMPAY). 
All personal data is fully protected and encrypted before transmission to the   bank  processing center Caisse d'Epargne (SYSTEMPAY). 
It is specified that the order validated by the Customer Care will be considered effective only when the payment centers concerned have given their consent. In case of refusal by the said centers, the order will be canceled and the customer notified by email.
Customer may be entitled to refund of the French VAT corresponding to the ordered product. To do this, it meets the requirements to receive a tax refund..
BibeliB eserves the right to reject any tax refund that does not correspond to the conditions specified in these Terms and Conditions as well as those requested by Customs.
All requests related to tax refund and / or VAT will have to be formulated after billing of the product referring to it.
Thus if the Customer resides and outside the European Union and overseas territories, that the purchased product is exported outside of France, the bill is sent to his home address and Customer wishes to benefit from a tax refund, this can make a demand for export sales receipt from services of BibeliB.
The price calculated and stated on the invoice will be inclusive of all taxes (TTC). The goods can be zero-rated will be the ones that the Customer has purchased for his personal needs retail for tourism and which justify export. Finally the amount of his purchases must be not less than 175,00 € (including VAT) xcluding shipping of participation and / or service offerings and / or promotions.
BibeliB  invites its customers to learn and control the conditions previously required to qualify for French VAT exemption.  
For inquiries related to the tax refund and / or VAT, BibeliB invites the customer to take its attachment by email at [email protected] or by mail at the following address : BibeliB - 16, boulevard de Sebastopol 75004 PARIS.  

SECTION 6 - PROPERTY OF THE COVER 
Luggage protective covers ordered delivered by BibeliB remain the property of BibeliB until full payment.  

SECTION  7 - DELIVERY
BibeliB is responsible for the choice of carrier. Shipping fees are the Customer (unless the customer chooses the shipping option: Relay package), being observed that a surcharge may be practiced by BibeliB in case of delivery outside French territory. 
BibeliB address the delivery of the order to the address specified by the Client. A deadline of delivery is communicated before the order confirmation. Applicable delivery times are those indicated in this order confirmation. 
In case of late delivery, the Customer must, after speaking to the Post Office or withdrawal, contact BibeliB by email at the following address : [email protected]. 
A carrier investigation is opened by BibeliB with the carrier to locate the parcels dispatched. This investigation may take up to fifteen (15) days from the opening date. If in the meantime, the parcel is found, it will be returned promptly to the delivery address specified by the Client. 
At the close of the investigation and if the package is not found, BibeliB address, at its own expense, the Customer a replacement product or, at request, refund thereof.   
Furthermore and Customer entrusts the receipt of the order to a third party, the latter is deemed to receive the parcel in the name and on behalf of the Client and is a result and as such responsible. Finally and in case of deterioration of the command such as livery, BibeliB can not be held responsible.  
Thus and receipt of the order, BibeliB invites the Customer to: Unpack the package; noted its reservations in detail; take all necessary photographs; notify by registered letter with acknowledgment of receipt sent promptly to; BibeliB and at the latest within three (3) days of the delivery, a letter of protest motivated by registered letter, failing which said protest will be considered inadmissible; keep the product delivered in the state. 
These precautions do not preclude the benefit of legal guarantees. However, they are necessary to the establishment of proof of the materiality of the protest. A delivery-compliance investigation is opened by BibeliB, to verify the content of the protest. This investigation may take up to fifteen (15) business days from the opening date. At the close of the investigation and if the protest is justified, BibeliB address, at its own expense, the Customer a replacement product or, at request, refund thereof.   

SECTION 8 - RETRACTION RIGHT 
The Customer has a retraction period of seven (7) calendar days to return, at its expense, the ordered product does not suit him. This period starts the day after receiving the product as indicated by the carrier. This deadline has expired, the Customer no longer has this right of retraction. When this period expires on a weekend, a holiday or holiday, it is extended to the next business day.
To ensure the proper management of returns, BibeliB invites its customers to report their returns before or by E-mail at [email protected], or by mail at the following address : BibeliB - 16, Boulevard de Sebastopol 75004 PARIS.  
In the event of the exercise of the right of withdrawal, the Customer may request that BibeliB proceeds either replace the product or refund ordered it, with refunds, effective and at Customer's expense, the product ordered him not unsuitable.  
This retraction right is without penalty. However, costs remain perfect return to the Customer..  

SECTION 9 - WARRANTY AND RETURNS 
Pursuant to Articles L. 211-4 to L. 211-11 of the Consumer Code, the Customer has a warranty against defects in conformity of products purchased on the website BibeliB.  
To comply with the order, the good must match the description given on the website  BibeliB well as the confirmed order and possess the qualities or presented features that a buyer might reasonably expect given the public statements made by  BibeliB, particularly in advertising, as well as those of the Client.
To ensure better treatment of the return and speed of his speech, the return request containing the delivered product, must be made indicating the reasons or by return E-mail to [email protected], or again by mail at the following address : BibeliB - 16, Boulevard de Sebastopol 75004 PARIS.  
In case of return request duly justified , BibeliB strives to regularize as soon as possible the problem faced by the Client.
Thus and in case of error or apparent non-compliance of the product ordered, provided that the delivered and returned product is not damaged, BibeliB process of replacing it or to demand reimbursement of the Customer. Otherwise, BibeliB reserves the right to apply a discount to the returned product. 
In any other case, the return is rejected and the product, quérable, left to the Customer available to such address indicated. No returns will be accepted nor any guarantee given in case of modification and / or alteration, however slight, of the ordered product. 
Return costs are borne by the Client. 

SECTION 10 - DATA SECURITY 
BibeliB guarantees a high level of confidentiality and security of data against current data protection techniques. However, it is the Customer's responsibility to ensure the protection of its own files. BibeliB not be held responsible for the Customer data loss.   

SECTION 11 - DATA STORAGE
BibeliB doesn't bring any warranty to the retention of data on its website. The Customer may not hold BibeliB liable in case of data loss.  

SECTION 12 – USE OF SERVICE
BibeliB  is authorized to check the contents of the data transmitted by the Customer. Customer is solely responsible for the content of the transferred material deposited on the  BibeliB website. 
In case BibeliB finds use of its service incompatible with these General Terms and Conditions, BibeliB reserves the right to remove content. For punishable contents, BibeliB will also alert the competent authorities. 
If third complaint about a user's data content, BibeliB will do the maximum possible to restore a healthy situation, but can in no way be held responsible for data dissemination. 

SECTION 13 - PROCESSING AND DATA PROTECTION
The data provided by the Customer remains the sole property of BibeliB. This data is subject to computer processing and are subject to change without prior notification of the Customer, including for the advancement of the status of his order. 
Under the Data Protection Act of January 6, 1978, the Customer has a right to access and rectify the data concerning him. 
BibeliB BibeliB reserves the right to collect data about the customer, including the use of cookies. BibeliB may, for commercial reasons, to transmit to a trade partner the identity and contact details of users of its services. The Customer is informed that this automated treatment of information, including management of users' e-mail addresses, has been declared to CNIL under the number XdT0327778H. 
Customer may be required to receive offers from other companies or organizations, or be informed of BibeliB offers by e-mail, by phone or mail. If the Customer does not wish, he can contact BibeliB for this purpose by email at  [email protected], by mail at: BibeliB -  16, boulevard de Sebastopol 75004 PARIS, or by clicking on the « unsuscribe » option listed on received messages.  

SECTION 14 - LUGGAGE INSURANCE 
NATURE AND SCOPE OF WARRANTY :  The Company Insureandgo guarantees the luggage of the insured worldwide, out of his principal or secondary residence, up to 500 euros per suitcase equipped with a  BibeliB  cover against theft and loss only during carriage by a company transport regularly authorized. For baggage means suitcases with dimensions of 60-82 cm. The bags must be equipped with their BibeliB cover and the Lost & Found system activated beforehand.
EFFECTIVE DATE AND DURATION OF WARRANTY : The insurance is valid for 1 year and limited to one claim, whatever the number of trips. It covers the luggage upon registration by the carrier and expires upon return at the time of final recovery by the insured with the carrier.
LIMITATION OF WARRANTY : In all cases, the maximum commitment of the Company is limited to the amount specified and purchased one claim per bag per year (purchase invoice of the cover). 
DISCLAIMERS AND OBLIGATIONS IN CASE OF LOSS : For a list of exclusions and the obligations for Disasters thank you to consult the general and specific conditions found  here.

SECTION 15 - ENTIRETY
In the event that any provision of this agreement shall be null and void by a change in legislation, regulation or court decision, this does not in any way affect the validity and compliance with these Sale Terms and Conditions. These Terms and Conditions constitute the entire agreement between BibeliB and Customer and supersede any agreement possibly intervened previously between the Client and BibeliB. 
Failure to BibeliB to exercise the rights granted him under these do not constitute a waiver of those rights. Article titles are only indicative value.

SECTION 16 - APPLICABLE RIGHT
These Terms and Conditions and the relationship between BibeliB and users of the website are subject to French law. Any dispute that could not find a way will be brought before the competent courts of Paris.
